These are often very sensitive matters which must be handled expeditiously, independently, and thoroughly. The investigations involve forensic review of electronic evidence (emails, reports, calendars, and documents), interviewing relevant witnesses, preparing a written report, and presenting the findings to company boards, inside counsel, or judges. These are all things we have done many times.
Our experience has included internal investigations in numerous substantive areas, including accounting fraud, healthcare fraud, government contracting fraud, insider trading, executive improprieties, side letters, and violations of the Foreign Corrupt Practices Act.
We have also advised and assisted clients on the ramifications of our investigative findings, including managing related regulatory inquiries and enforcement actions. This broad experience puts us in a very small group of practitioners best qualified to assist in an internal inquiry.
In our services to court-appointed receivers (see Regulatory Receiverships and Monitorships), we have also been tasked to objectively investigate businesses and report our findings in written reports on a compressed timeline.
